Activists have called for a Royal Commission of Inquiry (RCI) to be established following the demolition of homes belonging to the Jakun Orang Asli community in Pekan, Pahang.

The Association for the Protection of the Natural Heritage of Malaysia (Peka) president Rajesh Nagarajan said six houses and a community hall were demolished on May 4.

Speaking on Monday (May 11), Rajesh said an RCI was necessary as the case involved the alleged encroachment on Orang Asli customary land, as well as the demolition of homes without proper due process.

00:00So, okay, the reason that we are having, that we've called for this press conference today
00:04is in relation to the demolishment of houses of the Orang Asli Community, of the Jakun Orang Asli Community in
00:12Pekan Pahang
00:12Now, the facts are these
00:15The Orang Asli or the Orang Asal have been staying in that plot of land, that piece of land
00:21In Bahasa Malaysia, they'll say, sejak turun temurun
00:24In English, it's since time immemorial
00:27Because these are the real indigenous people of this country
00:31And they've been here since forever
00:34As long as they can remember
00:35You know, their grandfathers, grandfathers, grandfathers, everyone has always stayed in that plot of land
00:41And what has happened is that that plot of land, despite the indigenous people, the Orang Asli have been staying
00:47there since forever
00:48That plot of land is registered under the name of the Pahang State Government
00:55And the Pahang State Government saw it fit, despite knowing full well that the Orang Asli are living there, staying

01:03Despite that, they saw it fit to give a lease on that land to a palm oil company
01:11Now, if a palm oil company goes in, what is going to happen?
01:14That entire forest will be demolished
01:16All the trees will be removed
01:18And it will be replaced by palm trees, palm oil trees
01:22It will become a Ladang Kelapa Sawit
01:24How are the Orang Asli supposed to live in the middle of a Ladang Kelapa Sawit?
01:28How are you going to get water?
01:30How are you going to get food?
01:31How are you going to get shelter?
01:32Where are they supposed to stay?
01:34In other words, you are evicting them
01:37Now, what exactly is going on here?
01:41Let's call a spade a spade
01:42This is theft of the Orang Asli's land by the Pahang State Government
01:48That's what it is
01:50Now, why do we say it's theft?
01:51Because the land belongs to the Orang Asli
01:54Why do we say the land belongs to the Orang Asli?
01:57Because they have a constitutional right to the land
02:01Based on Article 13 of the Federal Constitution
02:04Article 13 makes it clear
02:06That the government cannot simply, willy-nilly take away someone's land
02:10There is a constitutional right
02:12Constitutionally protected
02:13Despite the constitutional protection
02:16The Pahang State Government took the plot of land
02:19And gave a lease on it to a Kelapa Sawit Company
02:25That is the background facts
02:28Now, what has happened is that
02:31That Kelapa Sawit Company has seen it fit
02:34To take a backhoe
02:36To the houses of the Orang Asli there
02:39The total of 21 houses there
02:41And seven houses have already been demolished
02:43And out of the seven
02:44One of it is what we call a rumah adat
02:47Which is something akin to a community hall
02:51Where the indigenous people will meet there
02:54For events, gatherings, weddings, funerals
02:59Their meetings, whatever will be held at the rumah adat
03:02The community hall there
03:03And that has also been demolished now
03:06And out of the six houses
03:08There are six houses and one rumah adat
03:10Has been demolished
03:11And out of the six houses
03:13Not only is the demolishment bad enough
03:16But one of the individuals whose house was demolished
03:18Is actually an OKU person
03:22And still you go and demolish the house
03:26It's completely unacceptable
03:28It's ridiculous
03:29How can you go and demolish the house of an OKU person
03:32Of an Orang Asli
03:35Now, that is what has happened
03:38In Pekan Pahang right now
03:41In any event
03:44We demand
03:45We demand
03:46That an enquiry be held immediately
03:49Under the Commission of Enquiry Act
03:53This is not a small matter
03:54You are demolishing the houses
03:56You are stealing the land of the Orang Asli
03:58This is a very, very, very serious matter
04:00And the repercussions must also be serious
04:03I.E. and Commission of Enquiry must be instituted on an urgent basis
04:07Now, just to touch on with what my colleagues and my friends here have said
04:12One very specific point that everybody needs to take into account is that
04:17When it comes to the Orang Asli
04:19Not only do they have a constitutional right to land like the rest of us
04:24They are supposed to be positively discriminated against
04:28This is also provided for
04:30Specifically in the Constitution under Article 8, Sub 5, Sub C
04:34Where it says that
04:35When it comes to the Orang Asli
04:37Their welfare
04:38For their welfare and for their well-being
04:43The government has the task
04:45Or has the duty of ensuring that they are given
04:48That they go over and beyond what they would normally do
04:51Considering the situation of the Orang Asal
04:54You know
04:55Considering their community
04:57That they don't live like the rest of us
04:59What has happened here is absolutely unjust
05:01And
05:02They are therefore a list of demands
05:05That we would like to make here today
05:07Moving forward
05:08What does the Federal Government
05:10And the State Government of Pahang need to do
05:12First things first
05:14There needs to be
05:15A gazetment
05:17Of native customary land
05:19For the Orang Asal of Pekan Pahang
05:21This must happen
05:23They have been living there
05:24They were never consulted
05:26No consultation was done with them
05:29They have always been there
05:32So gazetment needs to happen first
05:34That is the first thing
05:35Second compensation must be given
05:37They must be compensated
05:40For the damage that they have suffered
05:43As a result of their house being demolished
05:46Third
05:47Third there must be immediate and quick
05:49An immediate and quick investigation
05:51Into the police reports that have been lodged
05:53For criminal damage
05:54And for the trespass that has occurred
05:58One thing has been tried
